To take evidence

To take evidence

To investigate and inquire a person’s knowledge testimonies that he heard or saw for the purpose of a legal proceeding.

(Indeed they take evidence about the mute one who is not before them... It is good for the judge to collect the evidence in secret, telling the mute to bring witnesses, for it is against common sense and law - Yam Shel Shlomo, Massechet Ketubot, chapter 2; and likewise: The study hall of Rabbi Yehudah Hanasi and his students is bustling, their hands full of work: Gathering halachot, hearing reports, collecting 'testimonies', arranging, proofreading, recording - they are putting into a book the Oral Torah!)
