He Who Steals from a Thief Is Exempt

He Who Steals from a Thief Is Exempt

A popular proverb says that whoever steals from the hands of the thief is exempt from punishment (in the original, the thief is liable for punishment, but he is only exempt from 'double payment').

("The thief after another thief is not liable to pay double, and neither the cook nor the seller after another thief is liable to pay four and a fifth" - Baba Kama Sab A.B., and so: "The thief after another thief, even if the owners have despaired, is not liable to pay double" - Or Shamech Hilchot Geneva, Chapter 1)
