A deaf person, an insane person, and a young child may cause serious damage, because compensation cannot be recovered from them for the harm they cause. Under classical law, none of the three is legally responsible for their actions; however, anyone who injures them must pay for the damage caused to them.

חֶרֶשׁ טִיפֵּשׁ וְיֶלֶד קָטָן עֲלוּלִים לְהַזִּיק בְּנֶזֶק קָשֶׁה כִּי לֹא נִתָּן לִתְבֹּעַ מֵהֶם פִּצּוּיִים עַל הַנֶּזֶק שֶׁגָּרְמוּ. שְׁלָשְׁתָּם אֵינָם אַחְרָאִים מַעֲשֵׂיהֶם ע"פ הַדִּין הַקָּדוּם, אַךְ מִצַּד שֵׁנִי, מִי שֶׁפּוֹגֵעַ בָּהֶם חַיָּב לְשַׁלֵּם עַל הַנֶּזֶק שֶׁגָּרַם לָהֶם.
