לְגוּף שֵׁנִי נֶחֱשָׁב הַמִּשְׁתַּתֵּף בִּפְעֻלַּת הַתִּקְשֹׁרֶת כְּמִי שֶׁפּוֹנִים אֵלָיו אוֹ מִתְיַחֲסִים אֵלָיו כְּנוֹשֵׂא בַּמִּשְׁפָּט. לְגוּף שְׁלִישִׁי נֶחֱשָׁב גּוֹרֵם הַנִּזְכָּר בַּמִּשְׁפָּט אַךְ אֵינוֹ פָּעִיל בַּשִּׂיחָה.
